Terms & Conditions

Effective Date: 21/08/2025

These Terms and Conditions govern your participation with Fantacy Tribe and your purchase of any costume package, product, or service provided by Fantacy Tribe for Dominica Carnival 2026. By registering with Fantacy Tribe or making any payment, you agree to the following:​
 

Registration and Payment

1. All masqueraders must complete registration through the official Fantacy Tribe Website using accurate information. Information provided on registration will be considered final.

2. A non-refundable deposit is required to register and secure your Costume Package. Full payment deadlines will be communicated upon registration. Full payment of the costume package price must be paid before the stipulated deadline. Failure to do so will result in the forfeiture of all monies paid and the resale of the costume packages.

3. Once registered, the Masquerader shall not be permitted to change the Registered Section, including the body wear style, backpack upgrades or downgrades, measurements or sizes, or costume transfers.

​

4. The Band is not responsible for the sale / transfer of costume packages between two persons. The registration will remain in the name of the registered Masquerader. If the registered Masquerader wishes to sell / transfer their costume, they must provide the purchaser with a signed transfer letter of authorization and a copy of the owner’s identification and the costume package price must be fully paid by the stipulated deadlines. The Band is not responsible for transfer disputes.

Collection

5. The Costume is to be collected at the Distribution Centre during the Collection Period, such dates and periods to be communicated by the Band via its email, website and / or social media channels.

6. An Authorized Collector may collect on behalf of the Masquerader provided that this information is communicated via the website or email stating the name and photo identification of the Authorised Collector.

​

7. At collection, the Masquerader or the Authorised Collector must present at least one (1) form of government-issued identification. The Band reserves the right to take photographic evidence of costume package collection along with copies of personal identification and signatures on collection documents for verification purposes.

8. The Costume Package remains the property of the Band until the Costume Package Price is paid in full and the Costume Package is collected. Any costume packages left uncollected at the end of the final day for collection are considered forfeited and will be made available for resale.

Sizing, Fittings and Alterations

9. Sizing must be provided accurately during registration. The Band is not responsible for fit issues resulting from incorrect or outdated sizing submissions.

10. The Band is not responsible for alterations to any costume package body wear, backpacks, and all other accompanying items, accessories, and embellishments. The Band may make recommendations but the Masquerader is responsible for any alterations.

Refund Policy

11. ALL monies paid to the Band, inclusive of the Deposit and/or the Costume Package Price, are final and non-refundable.

Chargeback Policy

12. A Masquerader who files any unethical or unwarranted chargeback claims will be banned from the Band. In an effort to prevent fraudulent chargebacks, potential claimants must communicate with the Band directly to resolve any disputes or concerns.

Code of Conduct

13. The Masquerader agrees to follow all instructions, procedures, measures and directions given to him/ her by the Band or any of its staff or representatives and understands that his/ her failure to do so may result in property damage or injury or death to him / her or to a third party.

​

14. A Masquerader can be expelled from the Band’s Costume Package experiences for the following reasons:

a. Attempting or making fraudulent payments and initiating unwarranted chargebacks

b. Fighting, engaging in illegal activity during the Band’s Costume Package experiences

c. Disrespectful, demeaning, discriminatory abusive, racist, obscene or harassing behavior toward the Band’s owners, staff, entertainers, sponsors, affiliates and fellow masqueraders

d. Giving Costume Package drinks, food, wristbands, to revelers or onlookers who are not registered with the Band.

Use of Image and Likeness

15. The Masquerader hereby grants the Band, its directors, officers, employees and affiliates, the irrevocable and unrestricted right to use, reproduce, and publish photographs, videos, or other media taken of the Masquerader during collection of and participation in the Band’s packaged experiences in Dominica Carnival 2026. These materials may be used by the Band for its promotional purposes, including but not limited to marketing, advertising, social media, and other promotional materials, without further compensation to the Masquerader.

Indemnification

16. To the fullest extent permitted by the laws of Dominica, the Band and its affiliates, directors, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

a. The Masquerader’s use of or inability to use, and any interruption or cessation of transmission to or from the Band’s website or services.

b. Any unauthorized access to or use of the Band’s secure servers and/or any personal information stored therein.

c. Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Band’s website by any third party.

d. Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the website.

e. The quality, safety, suitability, or legality of any costumes purchased through the Band’s website.

17. In no event shall the Band’s liability to the Masquerader for all damages, losses, and causes of action exceed the amount paid by the Masquerader, if any, for accessing the Band’s website or purchasing the Costume Package.

18. The Masquerader hereby agrees to indemnify and hold the Band and its affiliates, directors, officers, employees, agents, and partners harmless from and against, and waives and covenants not to sue the Band and its affiliates, directors, officers, employees, agents, and partners for any and all claims, injuries, damages, liabilities, losses and cost or expenses (including reasonable attorneys' fees) arising from or in connection with his / her acts, omissions, activities, conduct and/ or participation in the Costume Package Experiences and events and activities hosted by the Band. This indemnity includes claims based on the negligence (whether sole, active, passive, or gross) of the Band, its directors, officers, employees, agents, affiliates, and volunteers, but expressly does not include claims based on their intentional misconduct.

19. The Masquerader declares that he/she fully acknowledges the risks of physical or other injury, exposure to Covid-19 or other communicable diseases or illness associated with attending and participating in Dominica Carnival and with the Band and its Costume Package experiences and hereby asserts that his/her participation is voluntary and that he/she knowingly assume all such risks. The Masquerader further understands that he / she is ultimately responsible for his / her own safety and acknowledges that he / she will comply with any health and safety protocols that may be in place during the Dominica Carnival 2026 and that failure to adhere may result in non-admission to the experiences.

Force Majeure

20. In the event of the cancellation of the Band’s Costume Package Experiences due to any action beyond the Band’s control including but not limited to acts of God, natural disasters, terrorism, or government actions, no refunds will be issued. Instead, affected parties may receive credit toward the next edition of the Band Costume Package.

 

Governing Law

21. These terms and conditions are governed by the laws of the Commonwealth of Dominica and the courts of which have exclusive jurisdiction to determine any disputes arising from these terms and conditions.

22. The Band reserves the right to amend these terms and conditions at any time and any such amendments will be published on the Band’s website.

23. If any provision of these terms and conditions is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the rest and shall not affect the validity and enforceability of any remaining provisions.

24. These terms and conditions constitute the entire agreement between the Masquerader and the Band in respect of the matters set out herein and supersedes any prior agreements, representations, or understandings.

By registering with Fantacy Tribe, you confirm that you have read, understood, and agree to these Terms and Conditions.
